Step 1 — Confirm Your Last Date of Work
Identify your last qualifying date of furnishing labor, materials, equipment, or professional services to the project. In West Virginia, this date controls mechanics lien deadline, including when the lien must be filed and when enforcement must begin.
Step 2 — Prepare the West Virginia Mechanics Lien Statement
The West Virginia mechanics lien formally asserts your lien rights and places a legal encumbrance on the property. It must identify:
the claimant
property owner
hiring party
legal description of the property
description of work performed or materials supplied
dates of work
the unpaid amount claimed.
Step 3 — File the WV Lien With the County Commission Clerk
Once prepared, the lien must be filed with the Clerk of the County Commission in the county where the property is located. This filing must occur within 100 days of your last furnishing of labor or materials. Filing in the wrong county, filing late, or submitting an improperly executed document will void the lien.

Step 4 — Serve the Property Owner (Mandatory)
After filing the West Virginia lien, the claimant must serve a copy of the recorded lien on the property owner. Service is a required step and is separate from filing. While West Virginia law does not specify an exact number of days, service must be completed promptly and in good faith after filing.

Sheriff or other lawful officer
Proof of service should always be retained. Failure to properly serve the owner can undermine enforcement and may render the lien unenforceable.
Step 5 — Enforce the West Virginia Lien
Filing the WV lien alone does not guarantee payment. If the owner does not resolve the debt, the lien must be enforced through a foreclosure lawsuit. In West Virginia, enforcement must begin within six (6) months after the lien is filed.
If a foreclosure action is not timely filed, the mechanics lien automatically expires by operation of law, permanently extinguishing the lien regardless of the amount owed.
