New York Construction Lien Guide

New York mechanics lien law is governed by the New York Lien Law (Lien Law §§ 1–79-a).


If you provide labor, materials, equipment, or professional services that improve real property in New York and are not paid, this guide explains how to protect your lien rights.


Keep in mind that New York Mechanics Lien, Construction Lien and Claim of Liencan be used interchangeably.

⭐ Who Can File a Mechanics Lien in New York?


New York grants Construction lien rights to:

  • General contractors

  • Subcontractors

  • Sub-subcontractors

  • Material suppliers

  • Equipment rental companies

  • Laborers

  • Architects, engineers, surveyors, and other design professionals

New York Construction Lien rights apply to private commercial projects, private residential projects, and public improvement projects, but deadlines and procedures vary.

⭐ New York Lien Deadlines (Critical)


LIEN IT OR LOSE IT!


All New York mechanics lien deadlines are calculated from the claimant’s last date of furnishing labor, materials, equipment, or professional servicesto the project. This date is critical because it controls both the deadline to record the lien and the deadline to enforce it, and New York courts apply these deadlines strictly and without exception.


Missing any mechanics lien deadline in New York results in a complete loss of lien rights. The law does not allow extensions, grace periods, relation-back arguments, or equitable exceptions, even when the debt is undisputed or the property owner had actual notice of the claim.


Deadline #1 — File the New York Mechanics Lien


For private construction projects, a mechanics lien must be filed:

  • Within 8 months of last furnishing, or

  • Within 4 months of last furnishing if the project is a single-family dwelling

Missing this deadline results in a complete loss of lien rights.


Liens are filed with the County Clerk in the county where the property is located.


Deadline #2: Serve your New York Mechanics Lien


After filing, the lien must be served on the property owner.

  • Method:personal service or certified/registered mail

  • Deadline: within 5 days before or 30 days after filing, depending on method

Failure to properly serve the lien can invalidate it.


Deadline #3 — Enforce the New York Mechanics Lien


A New York mechanics lien must be enforced by filing a foreclosure action:


       Within one (1) year from the date the lien is filed


If no action is filed within one year, the lien expires automatically, unless extended by court order.
