Wyoming Construction Lien Guide

Wyoming mechanics lien law is governed by Wyo. Stat. Ann. §§ 29-1-301.
If you provide labor, materials, equipment, or professional services that improve private real property in Wyoming and are not paid, Wyoming law allows you to secure payment through a mechanics lien, but only if every statutory deadline and service requirement is strictly followed.
Wyoming lien law is deadline-driven and unforgiving. Missing a notice, filing late, or failing to enforce the lien properly results in a complete loss of lien rights, even if the debt is undisputed.
Keep in mind that Wyoming Mechanics Lien, Construction Lien, and Lien Statement are commonly used interchangeably to describe the same statutory lien right.
LET’S LEARN THE BASICS OF WYOMING CONSTRUCTION LIEN
⭐ Who Can File a Mechanics Lien in Wyoming?
Wyoming grants lien rights to parties who improve private real property, including:
General contractors
Subcontractors
Sub-subcontractors
Material suppliers
Laborers
Architects, engineers, and other design professionals (when services improve the property)
Mechanics liens do not apply to public projects in Wyoming. Public work is protected through payment bond claims instead.
⭐ Wyoming Lien Deadlines (Critical)
Deadline #1 — Send the Wyoming Notice of Intent to Lien (NOI)
Wyoming does not require a traditional “preliminary notice” like many states. However, Wyoming does require a Notice of Intent to Lien (NOI) in most cases before a mechanics lien may be filed. The Notice of Intent to Lien is a mandatory warning notice that must be served before recording a mechanics lien.
Who Must Send the Wyoming NOI?
All lien claimants, including:
General contractors
Subcontractors
Suppliers
Design professionals
There is no exemption based on contract tier.
Wyoming NOI Deadline
The NOI must be served at least 20 days before the lien is filed
This notice does not extend the lien filing deadline. It must fit within the overall lien timeline.
Wyoming NOI Method of Service
You can serve the Wyoming Notice of Intent to Lien via:
Certified mail, return receipt requested, or
Personal service
Failure to properly serve the NOI can invalidate the lien.
Deadline #1 — File the Wyoming Mechanics Lien
All Wyoming mechanics lien deadlines are calculated from the claimant’s last date of furnishing labor, materials, equipment, or professional services to the project. A Wyoming mechanics lien must be recorded within 150 days of the claimant’s last furnishing of labor or materials. The lien is recorded with the County Clerk in the county where the property is located.
Make sure to include the following in your Wymoing Mechanics Lien form:
Name and address of the lien claimant
Name of the property owner
Name of the party who hired the claimant
Legal description of the property
Description of the labor, materials, equipment, or services provided
First date and last date of furnishing labor or materials
Total amount claimed to be due and unpaid
Statement that the amount claimed is justly due
Signature of the claimant or authorized agent
Verification (notarization)
Deadline #2 — Enforce the Wyoming Mechanics Lien
After recording the Wyoming Mechanics lien, the claimant must file a lawsuit to foreclose the lien within 180 days of recording.
If no enforcement action is filed within that period, the lien automatically expires and becomes unenforceable.
