Rhode Island Construction Lien Guide

Rhode Island mechanics lien law is governed by R.I. Gen. Laws §§ 34-28-1.


If you provide labor, materials, equipment, or professional services that improve private real property in Rhode Island and are not paid, Rhode Island law allows you to secure payment through a mechanics lien.


Rhode Island lien law is procedural and deadline-driven. Missing a notice requirement, filing late, or failing to enforce the lien on time may result in a complete loss of lien rights, even if the work was performed and remains unpaid.


Keep in mind that Rhode Island Mechanics Lien, Construction Lien, and Lien Petition are commonly used interchangeably to describe the same statutory lien process.

⭐ Who Can File a Mechanics Lien in Rhode Island?

Rhode Island grants lien rights to parties who improve private real property, including:

  • General contractors

  • Subcontractors

  • Sub-subcontractors

  • Material suppliers

  • Laborers

  • Architects, engineers, and other design professionals (when services improve the property)

Mechanics liens do not apply to public projects. Payment disputes on public work are handled through bond claims instead.

⭐ Rhode Island Lien Deadlines (Critical)


All Rhode Island mechanics lien deadlines are calculated from the claimant’s last date of furnishing labor, materials, equipment, or professional services to the project.


That date controls when required notices must be given, when the lien petition must be filed, and when enforcement must begin. 


Deadline #1 — File the Rhode Island Lien Petition


A Rhode Island mechanics lien begins by filing a Petition to Enforce a Mechanics Lien in the Superior Court.


The petition must be filed within 120 days of the claimant’s last furnishing of labor or materials.


Unlike many states, Rhode Island does not perfect a lien by simply recording a lien document. The lien arises only after court involvement.


Deadline #2 — Enforce the Rhode Island Mechanics Lien


Rhode Island lien enforcement is built into the same court action. Once the lien petition is filed:

  • The court sets a hearing

  • The owner is served through court process

  • The lien is established, reduced, or dismissed by court order

Failure to timely file the lien petition means no lien exists at all.
