Step 1 —Send Nebraska Notice to Owner
Before anything else, you must determine what type of project you worked on, because Nebraska applies different notice rules to residential construction.
If the project is a one- to four-family residential property and you did not have a direct contract with the homeowner, Nebraska law requires that you have sent the Residential Construction Notice within 45 days of first furnishing labor or materials.
Step 2 — Prepare the Nebraska Mechanics Lien
The Nebraska mechanics lien statement is the document that formally asserts your lien rights and creates a legal encumbrance on the property. Nebraska mechancis lien must identify:
Claimant’s legal name and address
Property owner’s name
Name of the party who hired the claimant
Legal description of the property
Description of labor or materials furnished
Amount claimed as unpaid
Dates of first and last furnishing
Verification or sworn statement
Any material errors, omissions, or inflated amounts can render the lien void or subject to legal challenge.
Step 3 — Record the Nebraska Mechanics Lien with the Register of Deeds
Once prepared, the Nebraska mechancis lien must be recorded with the Register of Deeds in the county where the property is located. This filing must occur within 120 days of your last furnishing of labor or materials. Filing in the wrong county or missing the deadline will invalidate the lien.

Step 4 — Serve the Filed Nebraska Mechanics Lien Property Owner (Mandatory)
After recording the mechancis lien, Nebraska law requires that a copy of the recorded lien be served on the property owner within 10 days of recording. Service is a mandatory step and is separate from filing.
Accepted Methods of Service:
Certified mail, return receipt requested, or
Personal service by sheriff or other authorized officer
Proof of service should always be retained. Failure to properly serve the lien within the 10-day window can invalidate the lien, even if it was timely recorded.
Step 5 — Enforce the Nebraska Mechanics Lien
Recording a Nebraska mechanics lien does not result in payment by itself. If the debt remains unpaid, the lien must be enforced through a foreclosure lawsuit. In Nebraska, enforcement must be commenced within two (2) years of recording the lien.
If no lawsuit is filed within that time, the lien expires automatically by operation of law, permanently extinguishing the claim against the property.
