Step 1 — Determine Whether Notice Is Required
Before filing, confirm whether the project is owner-occupied residential and whether you are a subcontractor. If so, verify that the Notice of Intention to Claim a Lien was timely sent.
Step 2 — File a Petition to Establish a Mechanics Lien
Maryland requires filing a court petition, not recording a lien with land records. The petition must include:
Property description
Owner information
Claimant information
Hiring party
Description of work or materials
Amount claimed
Dates of furnishing
Step 3 — Court Review and Show-Cause Order
The court will review the petition and may issue a show-cause order requiring the property owner to respond. If the court finds probable cause, it may establish the lien or allow the case to proceed.
Step 4 — Lien Enforcement Through Litigation
Once established, the lien is enforced through the same court action. Maryland liens are inherently litigation-based, and legal counsel is strongly recommended.
