⭐ How to File an Idaho Mechanics/Construction Lien (Step-By-Step)

Idaho Construction Lien

Follow these steps to file an Idaho mechanics lien and make sure you’re taking the right actions to protect your payment rights.

Step 1 — Send the Idaho Preliminary Notice (If Required)


Serve the Notice of Claim of Lien Rights within 45 days of first furnishing. This notice requirement applies to subcontractors, suppliers, equipment rental companies, and design professionals who do not have a direct contract with the property owner.


You can serve the Idaho Preliminary Notice via Personal service or Certified mail, return receipt requested.

Step 2 — Prepare the Idaho Mechanics Lien


An Idaho Mechanics Lien must include the following:

  • Claimant’s legal name and address

  • Property owner’s name

  • Hiring party’s name

  • Legal property description

  • Description of labor, materials, equipment, or services provided

  • Amount claimed as unpaid

  • Date of last furnishing

  • Claimant’s signature and verification

Step 3 — Record the Idaho Mechanics Lien


Iowa mechanics lien must be recorded with the County Recorder in the county where the property is located. Idaho mechanics lien to be recorded within ninety (90) days of the claimant’s last furnishing of labor, materials, equipment, or professional services. This deadline is strictly enforced, and missing it results in a complete loss of lien rights. Recording the lien places it in the public record and formally asserts the claimant’s interest in the property.


Step 4 — Serve the Recorded Idaho Mechanics Lien


After recording, the lien claimant must serve a copy of the recorded Iowa lien on the property owner within  reasonable time after recording, and best practice is to serve the lien immediately. Service should be completed using an approved method, such as certified mail or personal service, and proof of service should be retained. 


Step 6 — Enforce the Idaho Mechanics Lien


If payment is not resolved, the Iowa lien must be enforced through a foreclosure lawsuit. In Idaho, the enforcement deadline is within six (6) months after the lien is recorded. If no lawsuit is filed within this period, the lien automatically expires and becomes unenforceable. Ongoing negotiations, insurance discussions, or promises to pay do not extend the enforcement deadline, so lien claimants should calendar this date immediately after recording.
